ACCEPTANCE OF TERMS

The services that are provided to you by Homerschool.com, Inc. are subject to the following Terms of Use Policy.  Homerschool.com, Inc. reserves the right to update the Terms of Use Policy at any time without notice to you.

INTELLECTUAL PROPERTY

All  Homerschool.com, Inc. materials, lessons, concepts, format, Digital File Cabinet©, and all other original materials are protected by copyrights, trademarks, service marks, international treaties, and/or other proprietary rights and laws of the United States of America and other countries.  In addition, Homerschool.com, Inc. materials are protected as a collective work and/or compilation under U.S. copyright and other laws and treaties.  As a subscriber or end user you acquire no rights or licenses in or to any Homerschool materials other than the limited right to use these materials in accordance with these Terms.  You agree to abide by all posted copyright notices or restrictions relating to Homerschool.com, Inc.

DESCRIPTION OF SERVICES

Homerschool.com, Inc. provides you with access to a variety of resources, through its network of web properties.   Included and not limited to you will find the following resources: IEP forms, Lesson Plans, PDF files, Worksheets (Black line masters), Search engines, dictionary links, on line videos, laboratory activities, links to audio downloads, Power Point presentations, communication forums and product information that will be referred to as Collective Services. All of the Collective Services are and will include any and all required refinements, enhancements, new features, and/or the addition or deletion of any or all of the new web properties, are subject to the Terms of Use Policy.

PERSONAL AND NON-COMMERCIAL USE LIMITATION


The Collective Services that have been purchased are for your personal, classroom, and non-commercial use, unless otherwise specified. You may not copy, modify in any manner, transmit, display, distribute, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information, products or services obtained from the Collective Services.

NOTICE SPECIFIC TO SOFTWARE AVAILABLE ON THIS WEB SITE


Any software that is made available to download from the Collective Services is the copyrighted work of Homerschool.com, Inc. and/or its suppliers. Use of the software is governed by the terms of the end user license agreement, if any, which accompanies or is included with the software’s Licensing Agreement  An end user will not be able to install any software that is accompanied by or includes a License Agreement, unless he or she first agrees to the License Agreement terms.

All software that is made available for download is for the sole use by end users, in accordance with the License Agreement. Any reproduction or redistribution of the software that is not in accordance with the License Agreement is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the fullest extent of the law.

Without Limiting the foregoing, copying, transferring to another site, storage location, or  server, reproduction of the web pages, or any other components of Homerschool.com, Inc. for the further reproduction or redistribution in any incremental sizes or in totality is expressly prohibited without notarized written permission.

NOTICE SPECIFIC TO DOCUMENTS AVAILABLE ON HOMERSCHOOL.COM, INC.


Permission to use documents (such as black line masters and data sheets) from the Collective Services is granted, provided that (1) the below copyright notice appears in all copies and that both the copyright notice and this permission notice appear, (2) use of such documents from the Collective Services is for informational and non-commercial or personal use only and will not be copied or posted on any network computer or broadcast in any media, and (3) no modifications or alterations of any documents are made. Accredited educational institutions, such as K-12, universities, private/public colleges, and state community colleges, may download and reproduce the documents for distribution in the classroom only when the subscription holder has purchased the right to use the said information. Distribution outside the classroom requires the express written permission of Homerschool.com, Inc. Use for any other purpose is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the fullest extent of the law.

Documents specified above do not include the design or layout of the Homerschool.com, Inc. web site or any other Homerschool.com, Inc. owned, operated, licensed or controlled site. Elements of Homerschool.com, Inc. web sites are protected by trademark, unfair competition, and other laws and may not be copied, image transferred, or imitated in its entirety or in part. No logo, graphic, sound or image from any Homerschool.com, Inc. web site may be copied or retransmitted unless expressly permitted by Homerschool.com, Inc.

HOMERSCHOOL.COM, INC. and/or its respective suppliers make no representations about the suitability of the information contained in the documents and related graphics published as part of the Collective Services for any purpose.  All such documents and related graphics are provided “As Is” without a warranty of any kind.  HOMERSCHOOL.COM, INC. hereby disclaims all warranties.  In no event shall HOMERSCHOOL.COM, INC. and/or its respective suppliers be liable for any special, indirect or consequential damages or any damages whatsoever resulting from loss of use, or data whether in an action of contract, or negligence that may arise out of or in connection with the use or performance of information available from the Collective Services.

THE DOCUMENTS AND RELATED GRAPHICS PUBLISHED ON HOMERSCHOOL.COM, INC.  COULD INCLUDE TECHNICAL INACCURACIES OR TYPOGRAPHICAL ERRORS. CHANGES ARE PERIODICALLY ADDED TO THE INFORMATION HEREIN. HOMERSCHOOL.COM, INC. AND/OR ITS RESPECTIVE SUPPLIERS MAY MAKE IMPROVEMENTS AND/OR ALTERATIONS IN THE PRODUCT(S) AND/OR THE PROGRAM(S) DESCRIBED HEREIN AT ANY TIME THEY ARE DEEMED NECESSARY.

IN NO EVENT SHALL HOMERSCHOOL.COM, INC. AND/OR ITS RESPECTIVE SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS, WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER UNLAWFUL ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF SOFTWARE, DOCUMENTS, PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR INFORMATION AVAILABLE FROM THE SERVICES.

MEMBER ACCOUNT, PASSWORDS, AND SECURITY


For Collective Services you are required to open an account and complete the registration process by providing us with current, complete and accurate information as prompted by the applicable registration form. In addition you will be issued a teacher password as well as student passwords. You are entirely responsible for maintaining the confidentiality of your passwords and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Homerschool.com, Inc. immediately of any unauthorized use of your account or any other breach of security.  Homerschool.com, Inc. will not be liable for any loss that you may incur as a result of someone else using your password or account, either with or without your knowledge. However, you could be held liable for losses incurred by Homerschool.com, Inc. or another party due to someone else using your account or password. You may not use anyone else's account at any time.

NO UNLAWFUL OR PROHIBITED USE


As a condition of your use of the Collective Services, you will not use the Collective Services for any purpose that is unlawful or prohibited by these conditions, terms, and notices. You and/or your partner(s) may not use the Collective Services in any manner that could potentially damage, disable, overburden, or impair any Homerschool.com, Inc. server, or the network(s) connected to any Homerschool.com, Inc. server, or interfere with any other subscriber’s use and enjoyment of any Collective Services. You and/or your partner(s) may not attempt to gain unauthorized access to any Collective Services, other accounts, computer systems or networks connected to any Homerschool.com, Inc. server or to any of the Collective Services, by means of hacking, password mining or any other known method of illegal acquisition of data, design, or conceptual layout. You and/or your partner(s) may not acquire or attempt to acquire any data or materials through any means that has not intentionally been made available through the Collective Services.

USE OF SERVICES


The Collective Services may contain e-mail services, bulletin board services, chat areas, news groups, forums, communities, personal web pages, calendars, photo albums, file cabinets and/or other message or communication facilities that are designed to enable you to communicate with others (each a " communication system or services. You agree to use the communication system or service only to post, send and receive messages and material that are proper and, when applicable, related to the particular communication system or services. By way of example, and not as a limitation, you agree that when using the communication system or services, you will not participate in any of the following activities:

Abuse, defame, harass, stalk, threaten or violate the legal rights of anyone, may they be a student, subscriber, or unknown individual, (such as rights of privacy and publicity).

Falsify or delete any copyright management information, such as author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a file that is uploaded.

Data mine or otherwise collect information about others, including e-mail addresses.

Download any file posted by another user of a communication system or services that you know, or reasonably should know, cannot be legally reproduced, displayed, performed, and/or distributed in such manner. 

Publish, post, upload, distribute or disseminate any inappropriate, profane, defamatory, obscene, indecent, lewd, or unlawful topic, name, material, or information.

Restrict or inhibit any other user from using the communication system or services.

Upload, or otherwise make available, files that contain images, photographs, software or other material that is protected by intellectual property laws, including, by way of example, and not as limitation, copyright or trademark laws (or by rights of privacy or publicity) unless you own or control the rights thereto or have received all necessary consent to do the same.

Use of any material or information, such as images or photographs, that are made available through the communication system or services in any manner that infringes upon copyright, trademark, patent, trade secret, or other proprietary rights of any business (commercial or private), or individual party is prohibited by law.

Use the communication system or services in connection with surveys, contests, pyramid schemes, chain letters, junk email, spamming or any duplicative or unsolicited messages (commercial or otherwise).

Use, download or otherwise copy, or provide (whether or not for a fee) to a person or entity any directory of users of the Services or other user or usage information or any portion thereof.

Upload files that contain, corrupted files, time bombs, viruses, worms, or any other similar software or programs that could potentially damage the operation of any computer or property of another.

Violate any code of conduct or other guidelines that may be applicable for any particular communication system or services.

Violate any applicable laws of business or private regulations.

Homerschool.com, Inc. reserves the right to review materials posted to the communication system or services and to remove any materials in its sole discretion. Homerschool.com, Inc. reserves the right to terminate your access to any or all of the communication system or services at any time, without notice, for any reason whatsoever.

Homerschool.com, Inc. reserves the discretionary right to disclose and supply any information that Homerschool.com, Inc. deems necessary, in order to satisfy any applicable law, regulation, legal process or governmental request, or to edit, refuse to post or to remove any information or materials, in whole or in part.

Always use caution when giving out any personally identifiable information about yourself, your children, or your students.   Homerschool.com, Inc. does not control or endorse the content, messages or information found in any communication system or services. Therefore, Homerschool.com, Inc specifically disclaims any liability with regard to the communication system or services and any actions resulting from your participation in any communication system or services. Second and third party resources do not necessarily reflect the educational viewpoint of Homerschool.com, Inc.

NOTICES AND PROCEDURE FOR MAKING CLAIMS OF COPYRIGHT INFRINGEMENT


Pursuant to Title 17, United States Code, Section 512(c)(2), notifications of claimed copyright infringement should be sent to Service Provider's Designated Agent. ALL INQUIRIES THAT ARE NOT RELEVANT TO THE FOLLOWING PROCEDURE WILL NOT RECEIVE A WRITTEN OR ELECTRONIC RESPONSE.
